Kentucky Stormwater Laws and Regulations

The state operates under the Kentucky NPDES Stormwater Program, regulated through the Kentucky MS4 Phase I and Phase II Permits. The standard source is the Phase II MS4 Permit. Individual MS4s must meet a maintenance and good housekeeping requirement, and Kentucky DOW Regulations include Post-Construction Standards for New Development. This regulation “requires permittees to develop, implement, and enforce a program to reduce pollutants in stormwater runoff from land development that results from land disturbance of one acre or greater. The program must include controls for runoff from land development that results from land disturbance of less than one acre if part of a larger common plan of development that disturbs more than one acre.”
